Terms of Service
These Terms of Service (“Terms”) are an agreement between you and ResumePay (“we”, “us”) about your use of the ResumePay website and app (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Acceptable Use Policy. Our Privacy Policy explains how we handle your information. If you don’t agree, please don’t use the Service.
1. Who can use ResumePay
You must be at least 16 years old, and old enough to enter into a binding agreement where you live. If you use the Service for an organization, you confirm you’re allowed to accept these Terms for it.
2. Your account
- Give accurate information when you sign up, and keep it current.
- Keep your password secret, and tell us promptly if you think someone else has used your account.
- An account is for one person. You’re responsible for what happens under it.
3. What the Service does
ResumePay helps you build a career profile from your own documents and answers, check what each item is based on, and use it to write resumes, tailor and localize them for jobs, analyze job postings against your evidence, find internships, track applications, and prepare for interviews. We change and improve the Service over time, and may add, change, or remove features. Where a change takes away something you’ve paid for, we’ll tell you in advance where we reasonably can.
4. Your content
“Your Content” is what you put into the Service, such as uploaded resumes, the career information you enter or confirm, job postings you add, notes, and what the Service generates for you from them. You keep all your rights in Your Content.
You give us permission to store, copy, process, and display Your Content only as needed to run the Service for you: for example, to read your resume, to send relevant parts to an AI provider to do what you ask (see our AI Disclosure), and to show the results back to you. This permission ends when you delete the content or your account, except for copies in backups, which expire as described in the Privacy Policy. We don’t sell Your Content, and we don’t use it to train AI models.
You’re responsible for Your Content: that it’s accurate, that you have the right to upload it, and that using it with the Service doesn’t break any law or anyone else’s rights. Don’t upload documents that contain other people’s confidential or personal information unless you’re allowed to.
5. AI-generated content
The Service uses AI to read documents, compare your experience with job requirements, and draft wording. Everything it writes is a draft for you to review. We design it to work only from your verified information and to flag anything it can’t check, but AI can still be wrong, incomplete, or out of date, and checks can miss things.
- You decide what you submit. Before you send a resume, cover letter, or answer to anyone, read it and make sure every statement is true. You’re responsible for what you submit.
- Scores are estimates. Match strengths, ATS previews, and the other analyses are guides, not predictions of how any employer, recruiter, or applicant-tracking system will treat your application.
- No guaranteed outcomes. We don’t promise interviews, offers, or any other result from using the Service.
6. Internship listings
The Internships section lists postings gathered from employers’ public careers sites and from job sites, for your convenience. We aren’t the employer, we don’t endorse or vet employers, and we can’t promise a listing is accurate, complete, or still open. You apply on the employer’s or job site’s own pages, under their terms and privacy policies, and any hiring decision is theirs alone. Links to other sites are provided as is; we aren’t responsible for their content or practices.
7. Points and payments
- Points. The Service is free to use. Its AI features cost points, at the amounts shown on the Points page before you use them. If an AI task fails, its points are given back. Points have no cash value, can’t be transferred, sold, or exchanged, and end when your account is deleted.
- Starting points. A new account gets starting points once its email address is verified: more for an address at a school or university (such as one ending in .edu), as the Points page says.
- Invites. Each invite code works once. When someone new signs up with your code and verifies their email address, you both get the points the Points page shows. Codes are for people you actually know; we may withhold or take back points from invites we reasonably believe were faked, such as accounts made only to collect them.
- Buying points. Where offered, you can buy points in packs. A purchase is a one-time payment: nothing renews or is charged again. Bought points don’t expire while your account exists.
- Changes. We may change what actions cost, or the points given for starting and for invites, for the future. Points already in your account stay.
- Prices and taxes. Prices are shown before you pay, and may include or add taxes as the checkout page shows.
- Payment processing. Payments are handled by Stripe. Your card details go to Stripe directly and never reach our servers. Stripe’s own terms apply to the payment.
Refunds
Except where the law requires otherwise, payments aren’t refundable, including for points you haven’t used. If a payment is refunded, the points it bought that are still in your account are removed. If you were charged in error, or couldn’t use what you paid for because of a problem on our side, contact us at [support email] within 14 days and we’ll review it. Nothing here limits any right you have under the consumer law where you live, such as a right to withdraw from a purchase.
8. Acceptable use
Use the Service honestly and lawfully. In particular, don’t use it to invent or exaggerate qualifications, to impersonate anyone, to misuse other people’s information, or to interfere with the Service or anyone else’s use of it. The Acceptable Use Policy has the details.
9. Our rights in the Service
The Service, including its software, design, templates, and branding, belongs to us or our licensors. These Terms give you a personal, non-exclusive, non-transferable right to use it while your account is in good standing. The resumes and other documents the Service produces for you are yours to use however you like. If you send us feedback, we may use it without owing you anything.
10. Other services
The Service relies on other companies, such as payment processing by Stripe, AI providers, and optional sign-in with Google. Their terms may apply when you use those parts. The Subprocessors page lists who processes data for us.
11. Ending your account
You can delete your account at any time in Settings. Deletion is immediate and permanent, as the Data Deletion page describes, and any points left in the account end with it, without a refund unless the law requires one. Download anything you want to keep first; Settings can export all your data.
We may suspend or close an account that breaks these Terms or the Acceptable Use Policy, that we have to act on by law, or that puts the Service or other people at risk. Where we reasonably can, we’ll tell you why and give you a chance to download your data first.
12. Disclaimers
To the extent the law allows, the Service is provided “as is” and “as available”. We work to keep it accurate, available, and secure, but we don’t promise it will be uninterrupted or error-free, or that AI-generated content, analyses, or third-party listings will be accurate or suitable for your purpose. Some places don’t allow these disclaimers, so they may not all apply to you.
13. Limits on liability
To the extent the law allows, neither we nor our suppliers are liable for indirect, incidental, special, or consequential losses, or for lost opportunities, profits, or data, arising from your use of the Service. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim and 100 US dollars.
Nothing in these Terms limits liability that can’t be limited by law, such as for fraud, or for death or personal injury caused by negligence, or your rights as a consumer that can’t be waived.
14. Your responsibility to us
To the extent the law allows, you’ll cover our reasonable losses and costs from claims by others that arise from Your Content or from your breaking these Terms or the law.
15. Governing law and disputes
These Terms are governed by the laws of [governing law], without regard to its conflict-of-law rules. Before bringing a claim, please contact us so we can try to resolve it informally. If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live, and may bring proceedings in its courts.
16. Changes to these Terms
We may update these Terms as the Service and the law change. The date at the top says when they last changed. For changes that materially affect your rights, we’ll give notice in the app before they take effect. If you don’t agree to updated Terms, you can delete your account before they apply to you; continuing to use the Service after that means you accept them.
17. General
- These Terms, with the policies they refer to, are the whole agreement between you and us about the Service.
- If part of these Terms can’t be enforced, the rest still applies.
- If we don’t enforce a right straight away, we haven’t given it up.
- You can’t transfer your rights under these Terms. We may transfer ours as part of a merger, sale, or reorganization, and will tell you if we do.
- These Terms are written in English. A translation, if we provide one, is for convenience only.
